I have never seen a problem with the minor restrictions that some of us like to use. SXC in their wisdom would not have given us the right to choose, if they had not wanted us to use it.

43. posted by slonecker, Dec 10, 2005 3:57 AM

How ironic that some of those who proclaim the need to restrict their photos for reasons that at first blush seem plausible are the very same ones who put those photos on PAYG sites without any restrictions whatsoever. I can only surmise that their "concern" is adequately addressed by the tender of a buck or two.

The rationale that some use is so patently disingenuous that it gives me a headache to even read their posts. At least be honest...you are either trying to force feedback (in which case Flickr or the like is for you) or you do not think it fair that someone may actually use your photos in some manner to make some money.

As John Stossel says on 20/20..."Give me a break!"

#47, That isn't a very nice comment to #46.

My photos are restriction free, but I don't want to be part of a mean group that bashes other sxcers who feel the need to restrict their photos. Especially, those with people pictures.

So you can take me off the RFSXC list.

49. posted by slonecker, Dec 10, 2005 10:45 PM

I believe ALL comments here by posters who prefer RFSXC as a basic philosophy are being made tongue-in-cheek. I do not read any more into the comments as I know from long experience with SXC that respectfully agreeing to disagree is a hallmark of the forums.

50. posted by SteveFE, Dec 10, 2005 10:48 PM

Always have been RF. But I like getting downloads ;-) Fully restricted pics get shit-all downloads (unless they're seriously good, and mine are seriously not good enough to get downloads with restrictions).

PS, does restriction free still include "you can go ahead and download it but please contact me" ones (as opposed to "photographer MUST be contacted before you can even download a bean)?

I hope that no one actually takes any offense at this, it really is meant to be tongue-in-check as slonecker said. Sarcasm sometimes doesn't translate too well over a blog,

The whole point is just to organize a little, see if we couldn't get a consensus going, and they take it to the sxc community at large.

54. posted by hilaryaq, Dec 11, 2005 3:31 PM

@47.. uncalled for. @51, Gossamer asked to be removed from the list...
If Peter agreed that a member isn't a true sxc'er unless they were unrestricted he would only leave unrestricted photos be uploaded.. fun is fun, but your takng it too far.
I have no restrictions on my photos, and I don't feel I am a more valuable member than someone who does..especially when (for example) you have 24 pics unrestricted, and someone like Jyn has 189.. with some restrictions.. Jyn has more to offer the downloaders, even if you totally cut out her restricted photos she still has a bigger gallery and more downloads than you.... so what difference do restrictions really make. And now there is the added search feature, so I don't see what any of this achieved bar dividing the community and making highly valued members, some among the top downloaded on this site, feel that they are not true sxcers.. it's bullshit...

55. posted by kinderkram, Dec 11, 2005 5:18 PM

#52: Now he is really going to far. Look, what kind of photo he dedicated to you, Hilary:

[Nah, just kidding. But you should calm down now, lady. And take this blog as it was meant to be: a satyre.]

Maybe, Mr. a51media should mark this blog as an ironically meant contribution. After all, it could confuse some newcomers who think, that SXC isn't a community under the banner of LOVE, PEACE and HAPPINESS.

56. posted by slonecker, Dec 11, 2005 7:15 PM

1...23 RF and 1R, with the 1R probably being unecessary as under the circumstances the need for a model release is highly doubtful. Besides, the mere fact it has been uploaded would be a problem if a model release was necessary.

39...188R and 1RF, with the 1RF undoubtedly being an oversight. Is it really necessary to R photos of things like crawfish, pennies falling, and spiders (among many others)?

1's RF to total upoads ratio is 96%.

39's RF ratio is 0.5%.

Now tell me, whose numbers really reflect the priciples upon which this site was atarted in the first place?

What is galling to me is that so many enamored with Rs also upload to micro sites where the only requirement for downloading their photos is the tendering of payment. Use limitations are governed at a micro site by site Terms and Conditions, which Terms and Conditions are in every meaningful way reflected in SXC's Terms and Conditions. Given the similarity of the Terms and Conditions between micro sites and SXC, a cynic might be led to believe that an indentical photo uploaded to each only needs to be protected when money does not change hands.

If someone chooses to take up the R banner and express their opinion why Rs are okay, then at least offer a plausible argument they are effective in any way other than trying to mandate contact. Thus far no argument has been offered that even comes close,

Most people aren't that computer literate to be able to trace their photos..

58. posted by hilaryaq, Dec 11, 2005 7:23 PM

@54.. I made this point already, a person who pays for a photo and then uses this photo in a way that is against the terms and conditions of the site, eg. porn, racism etc.. is tracable. They have 99% of the time paid by credit card. Here, the person who abuses the system is anonymous, and can call themselves Joe Bloggs from the Moon if they want to...
I don't even care anymore.. do what you guys want to do, who cares about the rest of the members...

59. posted by slonecker, Dec 11, 2005 7:49 PM

They are traceable here as well, and without much effort. Ever heard of Sam Spade? I have used it to trace even behind corporate firewalls. Moreover, if a photo is used on an internet site, a webmaster can be found in about a nanosecond...

61. posted by slonecker, Dec 12, 2005 6:47 AM

For the past two years there has been a bitter and heated debate between RFers and Rers, the vast majority of that debate centering around the indignation of some that their photos were being used in commercial activities where money is involved. All the recitals in the world that commercial is by definition something in which money changes hands, and that commercial uses have always been a permitted use sing the day the site was first launched.

The issue was so divisive that many uploaders felt the need to leave SXC and move on to other venues, a significant loss to the SXC community.

When it became apparent that anti-commercial feelings were not in keeping with the premise behind SXC, some chose to adopt the tack that restrictions were needed to "protect" sensitive subjects such a photos of identifiable people. Of course, the need to protect such subjects seemed to be of minor concern to such Rers when it came to their photos of recognizable people to happened to live in foreign countries and were oftentimes quite poor economically speaking.

I have learned over many years of law practice that people are gracious when it comes to making their work available to others, but that such generosity goes right out the window when money comes into the picture.

This supposedly being a site for the free exchange of work with others, I just have a difficult time reconciling free exchange with such attitudes.

RFers have generally made their feelings known and have backed them up with objective and verifiable data. The others camp has yet to do so in any meaningful manner that can be subject to objective scrutiny.

Perhaps someday a real debate on the merits will actually take place, but such a debate has yet to occur.

62. posted by Johngard, Dec 12, 2005 10:34 AM

The major problem I have with restricted pictures is that many of the photographers don't even bother to reply to e-mails requesting permission (I haveat least a dozen requests that are months old).

You're then faced with the choice of using the picture anyway or going to iStock, paying a dollar or two and getting instant joy!

63. posted by Johngard, Dec 12, 2005 10:37 AM

And while I'm on my soapbox -- some guys put pix on SXC with restrictions and then put exactly the same pix on Morguefile, without restrictions!

i guess is not healthy in a free comunity use precious server space to upload any photo with restrictions.

Of the 50 most recently approved photos, the high today is 31 R'ed and the low is 19 RF'ed.

Forecast for tomorrow...expect more of the same, with the high taking a distinct turn upwards late in the P.M. Low expected to get even lower....

69. posted by a51media, Dec 14, 2005 3:28 AM

#64 Thats a great idea.

Slonecker - man thats really bad, 62% restricted. I have a hypothesis for the growing number of restricted, I think people (particularly new members) assume that restricted is the standard here. The site needs to explain that unrestricted is the norm, and restricted is used only when truly neccessary.

70. posted by eurok, Dec 14, 2005 3:44 AM

I've never put restrictions (mainly because I thought it would be pretentious and the photo wasn't good enough). And I've now seen my pics on book covers, record covers and posters, and was notified without asking.
Unrestricted works great! You get pride, advice, and of course a warm fuzzy feeling.

71. posted by slonecker, Dec 14, 2005 5:44 AM

"Blog Master"

Yes, it is growing and most of it is newcomers who you correctly note think that Rs are the norms within the system for getting feedback. I expect that at some point in the near future the site is going to have to come to grips with this trend.

BTW, to draw a comparison, of the 50 most recently approved photos at SXP the number of Rs was ZERO. No permissions are required if you pay a dollar or two for the same identical photo that can be had here. Why something needs to be protected here, but not there, seems a bit illogical.

Interesting thread....

http://www.sxc.hu/forum.phtml?f=showtopic&n=8147&p- =1

Reading some of the views expressed in the thread is very enlightening. The photos here are by amateurs (me included) and meant for stock use. Hard to reconcile arguments that say "I wanna have the final say" or "I wanna have feedback" with the notion that this is a site for freely sharing images.

Hi a51media,

1. There are users that only download but not upload images.

2. How about minimum 5-10 photos (approved by the site) with no restrictions to be a member of SXC.

3. What is the difference between "restriction free photos" and "public domain photos"?

4. Is it allow to sell prints of "restriction free photos"? (Have to change SXC Terms of Use?)

5. How about adding a new drop-down box for browsing "image categories" only for "restriction free photos".

6. When browsing-viewing categories, there is a kind of sort by date, size, login, etc... How about adding some additional sorts:

—RESTRICTION FREE PHOTOS... [for designers????]

—RESTRICTION FREE PHOTOS... [including for "print & sell"????]

—Public domain like...

—Photographer must be contacted and credited...

—Written permission is needed from...

In this way, people looking for restriction free photos can save time...

Hope it helps...

(I don't own a camera) It was not possible for me until I came apon this website. You sharing your photos with the rest of the world is the most generous and selfless thing i've seen. These days everybody just think of themselves and EVERYTHING is about making money. BUT NOT YOU!!. I think its great. Thank you again!

Hi, I'm an artist and a fairly new member here but wanted to thank all of you who provide photos without restrictions. I'm a user of MorgueFile photos because they specifically mention that the photos may be used for art references.

I totally understand the photographers who want some restrictions but, it's really difficult for us artists who need a reference for a certain subject & cannot get it for themselves. I normally only use portions of photos because I want my art work to be my own but when I do use a photo in it's entirety, I ask permission of the photographer. You don't know how many photographers DON'T reply to emails requesting permission or don't acknowledge any email that you send them. I also acknowledge the source photo if I post my art online.

That's a long-winded way of saying that I'm grateful for restriction-free photos and to applaud those of you who do post them.

However, I am extremely grateful to all contributors of unrestricted photos. I am impressed with the generous nature of all who are sharing, & I love the harmony & camradery of this site

I'm trying to create a line of greeting cards that I'm trying to market & sell locally...I found a great pic by Jim Reilly (Disco Girls) #279562, I have contacted him for permission to use it. If I don't hear from him, does that mean don't use it? And does this apply to all pics I find on the sight? I've given him credit by name and location on the back of the card even though I've altered the pic so that the faces aren't as direct - I changed it to an embossed gray look. (FYI, It's been downloaded over 5000 times, I don't know all the reasons it was used for though)..Thanks in advance for any advice!!

From the site terms of use: Always ask permission from the photographer if you want to use the Image
In website templates that You intend to sell or distribute.
For creating printed reproductions that You intend to sell.

I would suggest not to use an image for this purpose unless you have permission from the photographers.

247. posted by TMonee36, May 29, 2007 1:39 PM

Charcoal -
Thank you, I've read the site terms of use and then there was this blog area that seemed to have me believe the artists' actually like to have their pics used - as long as credit is given....I've read the stream line in this particular blog area and it seems to contradict the restrictions (in a wonderful way of course). I've written the photographer several times, and I've been looking at A LOT of the work here and found quite a few I really like - I think some of these people are very talented. The restrictions though...have me a bit scared and confused so maybe I'll just stop browsing. Really, what to do if you don't here from the artist?? I thought I'd found the perfect site!! Ahhh wellll (deep sigh)....Thanks for the advice Charcoal. Great Job Guys!

248. posted by artistsoul, May 29, 2007 3:34 PM

I was all excited until I read post # 243 so now I feel I'm back to where I was at in the beginning: having to ask permission to use possibly commercially. I say "possible" because I'm a starving artist, aka amateur artist and I need photos for references to paint or draw from. I would try to sell (maybe) what I drew or painted. Those who've signed up here: Are you telling us that we don't have to ask and wait for permission? I have gotten responses to my many requests and some I've not gotten responses from, over the past year or so. Does this mean those that are listed here I can go ahead draw or paint the picture, but then tell you I've done it just so you can know I used your photo? That seems far simpler...

I am a lousey photographer. I leave the photography to you geniuses! I don't know what I would do without your photos.

Thank you so very much.
Artistsoul, aka Faith
